I'm not a lawyer, but I met one once. Generally speaking, first in time is first in line. That said, there are some cases where an underlying document or rule allows the filing of the lien to occur and then revert back to the date of the underlying document. One case might be, the filing of a Notice of Commencement gives certain lienors lien rights that revert back to the date of filing of the Notice of Commencement. In that case, they may not file a lien prior to another lienor, but the Notice of Commencement grants them priority over another lienor who filed before them.
Condominium Associations file their Association Documents for all to see. If those fees are secured by way of a lien, they gain priority over some lienors. Federal Tax Liens attach to all property of the taxpayer, but not until recorded in the County in which the property is titled. etc, etc, etc
These liens that are the subject of this Thread are a first for me to discover. If they are held to be valid, I may know a firm or two who would pay for their assignment. I believe that Florida has entitled liens as assignable without the consent of the landowner.
