Florida Federal judge declares Obama Care unconstitutional

New posts
I'd like to see a real conservative speak against an action by the sort of 'activist judge' they usually set up as the perfect strawman.

Personally, I do not think there is any such thing. Funny to me that when a judge rules against the legislature, he is an activist, but when the public vote for something, and the legislature does not like it, first thing they do is take it to a judge.

They all are suppose to have equal power, and it is not suppose to be easy. Maybe the legislative branch could have written the law where portions could have been severed, but sort of like they try to tie the hands of the President, they wrap it all up in one package and now this is what we get. And now with the change in Congress, fixing this is not going to be easy.

Doesn't this all, again , boil down to, we cannot have health insurance that accepts people with pre-conditions unless the "group" is incredibly large (i.e. "everybody")? This is simple mathmatics. I'm not sure why everyone dances around this simple equation. :idontno:

Can someone give me an example of another private service that I AM REQUIRED by law to purchase so that someone else can buy a similar private service. I am drawing a blank.

I don't know that you can call this guy an activist judge - the only reason he was issuing an opinion was because he had to rule on the case brought before him (by 26 states).

I (and this judge too BTW) still think the health care bill has a lot of good and long overdue changes in it.

If there is some aspect of it you don't like, it can be amended - throwing out the entire bill is stupid. Especially when your reasons for doing so are misleading or false talking points and politricks.

I agree there are some parts that are good and should be used but why not create a bill written by both parties. Bipartisan support is the only way to make this work for everyone. They owe this to the American people.

Can you name me a western developed country that has a system where corporations make over 20% profit on the health care of it's citizens?

How am I mistaken? I said that it was the mandate that was cited as being unconstitutional. That's what the judge said. No? You quoted him yourself as saying that.

Andy, you posted something factually incorrect. And then you get all passive aggressive on me for pointing it out with- "you're right, as usual". What is your deal lately?

Geo, I am not a lawyer, although I have worked for many of them, and I did stay in a Holiday Express once...when the ruling says the law is not severable, it means it can not be separated...so, you have it all or you have nothing...but remember this is just another opinion and probably is full of loopholes that will show up on appeal...and I do belive it will eventually be before the Supremes.

I am guessing the answer will be the US. So, I will play this game. Can someone give me a private service that another country requires their citizens by law to purchase so that another citizen can get it? Please differentiate between those services that a person pays for with after-tax monies. Not those services paid for by government taxes.

OK: We all pay for the vast amount of weapon systems that the US invests in, the vast amount of interstate highway system the US invests in, whether anyone wants to have the biggest weapon system in the world, or whether a person even owns a car to drive on the interstate highway system. Shall I go on about the number of government systems that I have to pay for that I don't use?

Understood. I don't dispute that. I'm not saying the judge didn't rule to throw the whole law out. I'm simply saying what the judge did- that his ruling was that the individual mandate is unconstitutional. If the mandate wasn't in there he wouldn't have ruled the rest of it unconstitutional. A semantic difference? Perhaps. But a difference nonetheless.

"Because the individual mandate is unconstitutional and not severable, the entire Act must be declared void."
