Eleven states to challange mandate in court

At the center of the controversy is the bill's inclusion of a federal mandate requiring all Americans to purchase health insurance or face penalties. Opponents say this measure stretches Congress?s constitutional power to ?regulate commerce ? among the several states? beyond any meaningful limits on federal authority. They say Congress is authorized to regulate behavior to protect public safety or welfare, but federal lawmakers overstep the constitutional limits of their power when they begin ordering Americans to purchase certain products.

?With this law, the federal government will force citizens to buy health insurance, claiming it has the authority to do so because of its power to regulate interstate commerce,? Cuccinelli said. ?We contend that if a person decides not to buy health insurance, that person ? by definition ? is not engaging in commerce, and therefore, is not subject to a federal mandate.?

The Virginia attorney general added: ?Just being alive is not interstate commerce. If it were, there would be no limit to the US Constitution?s commerce clause and to Congress?s authority to regulate everything we do.?

In addition to challenging the individual mandate to buy health insurance, opponents had threatened to sue to block favorable concessions to the states of Nebraska and Louisiana that were designed to entice senators from those states to vote in favor of the healthcare bill.

We knew this was coming. It'll be interesting to see what happens. I honestly don't know how the SC will interpret the mandate. The commerce clause has been used and abused many times, even by more conservative courts concerning marijuana legalization laws. Time will tell, we have a full four years to work toward a final ruling.

FYI - The state of Florida is one of the states launching a challenge.

Yes, I just wish this wasn't from the The Christian Science Monitor. Needs to come from the left at this juncture.

I do believe we will end up with a compromise between Fed and States. That's a good thing.

Don't be surprised if we hear the teabaggers are trying to talk them into going for a trifecta by adding the civil rights act and womens suffrage to the challenge.

Christian = Right Wing. The fact is governors who are Dem and Rep are investigating the Constitutionality of this bill being signed into law.

It's an article, not an editorial. Why "should" it come from the left wing?

CSM is known for factual reporting, not opinion pieces. And, they are not "Christian", they are owned by the church but I don't really see a slant in their reporting.

CSM's not affiliated with religion or the religious right. It's just got a funny name. The site is very highly ranked on Google News. Never judge a book by it's cover Lynnie! :D

Good for you. I don't either, but I imagine some would shy away from this due to the name alone. Just my opinion.

Well, back when I was in Journalism school (we used quill and papyrus), the CSM was renowned for their intelligent, factual reporting. Their standards were impeccable, and we didn't know anyone who was ever able to get a job with them.

To this day, they do not just reprint items from the news services, they use their own reporters, around the world.

They currently have an excellent "FAQ" about the health care bill that I think everyone needs to read.
