Back up a minute. He "made a judgment error of speed?" How can you say that, followed by stating that "he may have fallen asleep and ran the stop light?" If you have looked at the missing heavy-duty guard rail and the missing signs beyond that, there is no way a logical person could say that "he made a judgment error of speed." There are no tire marks indicating that he never even braked nor attempted to turn through the T-shaped intersection.

SJ, I have not seen it but have heard basically what you have stated about no"tire marks" and the damage to the guard rail Do you think just leaving a party would have anything to do with any of this? But again just glad no one was hurt

I don't care to speculate on what caused the person to crash. I know no other information than my own observations at that intersection. I do know that the sole act of attending a party doesn't make people blind to traffic lights and roads ending into trees. Statistics show that talking or texting on a cell phone while driving, can be more hazardous than being legally intoxicated while driving, so let's not start pointing fingers as to the cause, without knowing.

Driving while eating has to be equally dangerous. I once heard someone say, "When drunks drive, at least they're TRYING to drive. People who eat and drive are trying to eat."

Just one word. BEAUTIFUL!!!! I'm still laughing

There are ways around a breathalyzer. Don't think a trooper is above trying to help a fellow LEO. I have personally seen such an instance with an off-duty bailiff years ago.

I agree that this cannot be attributed to "undue speed." He just didn't even try to make the turn!

forgetting something?

The cop was on his own time in his own car and made a judgement error of speed. His BOC was well below the legal limit (.048). He may have fallen asleep and ran the stop light. Glad he is OK. He is charged with reckless driving.

I think there are a few things being overlooked.

The driver of the vehicle is a certified law enforcement officer highly trained in the detection of impaired drivers and the affect alcohol has on the body.

His BAC (blood alcohol) being "well below the legal limit" is hogwash. The crash proved it was above his limit and ability. Some people are smashed with only one beer or mixed drink.

He could have been charged with impaired driving. Better cases have gone to court with less evidence.

It appears this particular traffic crash investigation was tainted as much as the driver.
Ask anyone that has a CDL, commercial driver license, and ask what the BAC limit is. You'll be shocked!!!!!
Ask surviving family members if .04 is enough to cause impaired driving. Call MADD, they will put you in touch with some.

I recognize the cheese its and the coors lite but what in the world is that in the middle?????????:yikes:

Seeker1, either you have inside information or you are making some HUGE assumptions. For example, a person could be under the legal limit, let's say a 6 ft male weighing 210 pounds who just consumed one 12 oz Budweiser. They are busy texting messages to Kimmifunn in Los Angeles, about Johnny Depp's look-a-like being in Sandestin. They blaze right through the intersection, taking out the guard rail and Sheriff Johnson's illegally placed signs. You suggest that the person crashed because they were drunk, but isn't it possible that he crashed because he was texting Kimmifunn, rather than looking at the road?

There were no skid marks at all at that intersection. A drunk person would have at least tried to hit the brakes at some point in time, unless they were well beyond blowing a 1.0 BAC. I'm not saying the driver wasn't drunk and that some shady things didn't happen. What I am saying is that without inside information, it isn't right to be making huge assumptions regarding the incident.

forgetting something?

I have no contacts at this time with anyone relating to the crash or its investigation. I never said or implied anyone was drunk. I suggested or implied that the driver was impaired based upon a reported BAC of .048.
If a driver has a commercial driver license (CDL) they are considered impaired at .04 or greater. A regular license is .08 BAC or greater. And as I stated before a person can be charged with impaired driving at .04.
Florida and other states as well state that a person is impaired at .04.
Judgement is the first thing alcohol affects in an impaired person.
Whichever license the driver possesses, or whatever excuse is offered as the cause for the crash the known evidence suggests he was not operating his vehicle in a manner that is safe for himself, his passengers if any, or the general public. Impairment was probably the leading responsible factor. (fl. statute 316.193 and 322. 62)
As I said before, the driver is a highly trained law enforcement officer trained in the safe operation of a vehicle and in the detection of impaired drivers and the affects alcohol has on the body. I would hope to think that the driver operated his vehicle using poor judgement rather than a deliberate well formed decision.
As for the policy of this sheriff department or any other law enforcment agency, it should be considered an offense resulting in immediate termination for operating any watercraft or motorvehicle with any level of alcohol in the drivers blood at the time of the incident.
There is no defense to impaired driving. I invite responses from Sheriff candidates.
