Walton County ordinance 2003-07G states: it shall be unlawful for beach chairs, umbrellas, tents and other such personal articles to be on the beach in such a manner that they interfere with beach maintenance, nesting turtles, or emergency vehicles.

The Walton County Sheriffs Department, TDC beach maintenance staff, Code Enforcement, and the Walton County beach activities coordinator will all aid in the implementation of ?Remove it or Lose it.? The Walton County Sheriffs Department will tag items on the beach giving owners and beach vendors 24 hours to remove the items from the beach. The tag will have a date, time, and description of the item observed on the beach. Items left near county walkovers and TDC maintained beach receptacles will be removed without being tagged. The TDC beach maintenance staff will remove all items that have remained past the 24-hour notice. The ordinance as written applies to all areas falling within the definition of ?beach,? regardless of whether such areas are located on public or private property. However, articles that are stored adjacent to or underneath personal walkovers will not be removed. For more information, contact Code Enforcement at (850) 622-0000.

So if my beach goes 20' past the dune line, Walton County has passed an ordinance that allows them to come onto my private property, tag, and take my stuff? That would be some expensive stuff, if it were mine. Talk about opening a can of worms.

It is primarily a turtle issue. I understand your private property issues, but this is more an environmental issue than an asthetic issue.

Taking something without permission, no matter what, is stealing. The statute does not exempt the government. They have a way that they can exercise eminent domain and seems that they choose not to do so. It is a wonder someone does not get hurt over this issue.
 
Sounds like an Onion headline "Walton County exercises eminent domain to rid beach of cheap broken chair. 3 fatalities reported." :roll::roll:

I think it is equivalent to parking in a no parking zone. Or, posting signs in the right of way. Ordinance - tag - remove.

How would you define abandonment in this case? I am guessing your issue is with taking stuff from privately owned beaches versus publically owned beaches, right? If a chair was left at a park in nowal it would be abandoned, but in your yard, it would not be, right?

I am talking about taking stuff from privately owned beaches. If it is left on a public beach it is littering.

Again the problem does become just what is the privately owned portion of the beach. But I am sure that there are some places in sowal in which it is obvious that it is privately owned. If someone wants to leave a tent up at the foot of their walkway on their property, the government needs to leave it alone.
