Re: Noise Ordinance

The earplugs are for MY ears!

And the parents are usually too busy talking on their cell phone and annoying the flight attendant w/ their excessive carry ons to notice! ;-)

Re: Noise Ordinance

SECTION 13. ENFORCEMENT.
1. This section governs the initiation of enforcement actions, the issuance of citations and/or
summons for violations of this Code, and the imposition of penalties for violations of this
Code.
2. If a person violates any provision of this Code, or an order issued pursuant thereto, the
enforcement agency may issue a citation and/or summons, institute an action in a court of
competent jurisdiction for injunctive relief to prohibit and prevent such violation or
violations, in which event the matter shall proceed as a summary matter in Walton
County Court or the municipal court of competent jurisdiction.
3. Any person violating any provision of this ordinance shall be punished as follows:
A. First Offense: By a fine of one hundred dollars ($100.00).
B. Second Offense: By a fine of two hundred and fifty dollars ($250.00).
C. Third offense or two or more violations occurring within any six months period:
Misdemeanor of the second degree punishable by a fine of no more than $500.00
and/or a sentence of not more than sixty (60) days in the county jail.
...
E. Each day that a nuisance noise exists shall constitute a separate violation of this
ordinance.

Seems to me that one could pay the $100 fine and party the entire night without committing the second offense until midnight.

Thanks for finding the Ordinance number, Aggie.I notice that during the weekdays, construction noise can begin at an early 6:30am. Glad I don't have any close neighbors hammering. On Saturdays, it can start at 7:00 according to the Code.

Re: Noise Ordinance

At the meeting for this, there was a lady living in BM complaining about the noise at one of those big condo things that they build. But since it being passed, all I have ever heard about are complaints about bar noise, late at night. Not to long ago someone wrote a letter to the editor about the Blue Bar, and that place on 30-A that sold the cracker rolled sandwiches a few years back was getting a lot of complaints. But no one seemed to be able to do anything, the SO referred them to CE which was not available on the weekends. Oh yea and the JAzz Festival at Gulf Place was generating complaints cause the wind blew the noise back into the subdivision behind them.

How could anyone call the Jazz fest music NOISE!!!They should be so lucky to hear it for free:bang:

Re: Noise Ordinance

So they are not allowed to disagree with you? Maybe they worked all night and are trying to sleep the next day.
I didn't notice that goodwitch posted "throw them in jail for calling the Jazz fest music noise" or the like. How do you get "not allowed" out of it?

I jumped to a very long distance conclusion. So sorry. This darn empty chair thing has got me frazzled.

Re: Noise Ordinance

I think that people complain about party noise because they think something can be done. Most people do not complain about construction noise because that's the sound of greed, and they are just wasting breath.

This lady (a friend of mine) was rightfully complaining. It was when they were building the condos with the blue roofs (village of blue mountain?) and they were working late into the night, past her children's bedtime, and with bright lights. It was a real problem for them.

I know one woman who lived in White Cliffs while Adagio was being built. She was instrumental in getting the noise ordinance passed. Another woman with school age kids who lived there spoke at several BCC meetings. At the time, construction was going on all night long. With those backup beepers and flood lights. Her kids got sick.
Barking dogs have been a problem off and on also. Years ago, before anyone even thought about a noise ordinance, I had a neighbor who would tie her Doberman to her front porch every evening and go off to work the night shift at Tom Thumb. That poor dog, it howled all night, an ear-splitting high-pitched howl that was beyond anything earplugs could shut out. I melted down in the middle of the night after weeks and weeks of this and got nearly hysterical in the Tom Thumb. I believe I may have threatened to put the dog out of its misery. It's amazing what sleep deprivation will do to you.
