Court allows agents to secretly put GPS trackers on cars - CNN.com Court allows agents to secretly put GPS trackers on cars

August 27, 2010 3:07 a.m. EDT (CNN) -- Law enforcement officers may secretly place a GPS device on a person's car without seeking a warrant from a judge, according to a recent federal appeals court ruling in California.

Drug Enforcement Administration agents in Oregon in 2007 surreptitiously attached a GPS to the silver Jeep owned by Juan Pineda-Moreno, whom they suspected of growing marijuana, according to court papers.

When Pineda-Moreno was arrested and charged, one piece of evidence was the GPS data, including the longitude and latitude of where the Jeep was driven, and how long it stayed. Prosecutors asserted the Jeep had been driven several times to remote rural locations where agents discovered marijuana being grown, court documents show...... "we just wanted to see what you were doing yesterday"

What judge in their right mind would endorse such a blantant disregard of the Constitution? This is an outrage to a free people. If they can do it to drug dealers today they can do it to you tomorrow if you get sideways with the government.

Maybe we need to add the citizen's GPS devices to all police and government cars, so that we can see where they are.

Some are saying it is class separation as well, because the ruling hinged on whether or not the vehicle was behind gated property. If one cannot afford to have gated property, then one could be tracked.

I doubt that will matter. The report suggested that people shouldn't expect to have privacy in their driveway. If there is a gate, the cops would only need to attach the GPS while the vehicle is parked at a public location, like the parking lot of the grocery store, or maybe while at the court house while buying their tags.

The very idea of the police tracking citizens without a warrant is an abomination and clearly a violation of the 4th Amendment. This is what happens when you disregard what it says. If the government can ignor one part of the Constitution then they can ignor all of it.

The U.S. Ninth Circuit Court of Appeals rejected the appeal twice -- in January of this year by a three-judge panel, and then again by the full court earlier this month. The judges who affirmed Pineda-Moreno's conviction did so without comment.

This makes no sense to me. Maybe there are some circumstances that surround this we are not aware of.

I would be more upset about this if I didn't think (based on tv shows) that law enforcement can already access your cell phone GPS, car's GPS, auto toll road tracker, monitoring bracelet, metro card, credit cards, etc. to get your location.

Why did they need to ADD a GPS tracker? Didn't the car already have one? What do you think On Star is?

Wholeheartedly support GPS tracking on any "government supplied car" to make sure it is only being used for official use! I have some serious concerns about what the cars and gas my taxes pay for are being used for.

But I think they should still need a judge to sign off on it. I bet I technically "visit" some meth labs and pot operations when I am shopping for real estate and garage sales.
