Upcoming Sheriff's Race - Josh Sconiers

I was referred to this site by a close personal friend. It appears that I along with many others have been the subject of many postings. Many questions arise to my qualifications to seek public office and that I am apparently way to young to be a Sheriff.

Unlike a few people who have already jumped into this race I want to do the right thing and abide by the law. This is not to delay or to give an excuse but rather to uphold a much stronger value of integrity. There are several laws that dictate when certain individuals seek a public office such as that of "Sheriff" that they must resign from their jobs in order to do so. I for one know what the law states, the reasons why these laws were created and I will abide by the law. I have strong morals and hold myself to a very high standard. I do not seek to split the vote, have not been paid by someone to enter this race but rather I feel lead to stand up for what is right and to do the right thing by giving the people a voice in the way their Constitutional Officers conduct the business of the people.

By no means am I to young to seek public office. I believe the misperception that comes of this assumption is brought on by the fear of change. Youth in politics breeds ambition, drive and a genuine desire to please the members of the public. I believe that qualifications for public office or for that fact any job position should be based upon character, skills & abilities, and most importantly life experiences. By judging ones life experiences you can determine what type of person you will be electing to a public office and more importantly what type of mold that office will take under such leadership.

Here is a question to ask yourself: When you are faced with a difficult decision to do what you believe is right or to go the other way because a few people attempt to sway you to do something; Will you do what you feel is right or make a decision that you know deep down is wrong simply because a few people tell you to do it? I for one WILL ALWAYS do what I feel and know is right thing to do. I stand upon principle and purpose. Some people are scared that results will be “diluted” because of candidates enter a race. I feel that they fear that some of us may have more to offer the people. I can clearly appreciate 3 people in a race where one person is evil all the way around, one seeks personal gain and the last person values integrity and puts the interest of all people ahead of his own. Unfortunately there will always be those who can never get enough and want to build a kingdom where they have the only say as to how an organization is run and never let the voice of the people and employees mold the way the organization operates.

"Watcher” rest assured that I am not trying to avert giving you the answers you seek about me but rather I am waiting to when the time is right and so that I will abide by the law. God may pull the ground out from under my feet tomorrow but today he is leading me forward. When the time is right I will know if it is his will that leads me into this race or not. Please do not bash my spiritual beliefs. I do not and will never force my personal beliefs on others. That is one thing that will definitely differ from me and some of the other candidates. Trust me, in a few months I will give you everything that you want to know about me. For now evaluate those who are out there, find out what positive attributes each of them have so that if and when I come out you can see what I have to offer that is different from all of the others.

Re: Upcoming Sheriff's Race

If elected, will you or your Deputies arrest beachgoers for sitting on the beach, as they have done for many years?

Thanks for trying to get your message out to the public.

Mr. Josh Sconiers:

Your post on this site shows your intelligence and your honesty. I understand and fully appreciate your explaination. I am very aware of your high standard of integrity, it is one of the reasons I respect you as a person.

I do not believe I ever bashed your personal beliefs, I'm not sure if that was a general statement in your post or if I miss read it. (no need to respond)

I can only urge you and any other candidate (current or potential) to really look at the potential to split the vote and allow the incumbent to remain in control of his fiefdom.

I will look forward to your additional comments when the time is right. Best of luck to you in your endeavors.

Thanks for the post - I appreciate hearing directly from a candidate. I do have a question based on the above quote. Understand if Mr. Sconiers does not want to answer, but it was the way he hinted at candidated violating the law that brings this question up.

Aside from Bill Imfeld, who was violating the Hatch Act, what other candidate is running contrary to the law at this time.

A lot of people are claiming Mike Adkinson is in violation of the Hatch Act, the resign to run law, etc.

My understanding is law enforcement officers are exempt from Florida resign to run, unless you are running against your boss. A current deputy running against a sitting sheriff would seem to be a problem. (Does that cause problems for other candidate?) Adkinson is not 'under' the sheriff, and would not have to resign under this law.

The Hatch Act, does not seem to apply either. Aren't elected official excluded from it? If so, since Adkinson is an elected chief of police, he wouldn't have to resign.

If I am wrong on any of this let me know, and if any one else is violating a law, please update us. If not, lets not make vague accusations - its bad for both candidate and voters.

Re: Upcoming Sheriff's Race

Josh, I appreciate you posting a bit about yourself on here. As a reminder, this is a message board, where discussion should be two way. Please follow up with some of the questions presented to you.

I'd like to hear more about the beach trespass issue the public is facing in Walton County. Let me first start with the laws of trespass. I have read the laws on trespass, and am as confused as the lawyers I've asked. What is the determining factor between civil trespass and criminal trespass? The law is very vague, yet the potential penalties vary greatly. The person arrested for being on the beach this past summer was charged with criminal trespass, yet I don't see how sitting on the beach is a criminal act. I am told that the arresting officer makes the determination as to the charge.

My second question comes in proving trespass. If you, as an officer, receive a call regarding trespass, isn't the burden of proof upon the property owner to show the trespass, by presenting a current boundary survey and a deed, or do you just take their word for it?

If you are going to tease us with a bio, please take the time to follow up with us.

Re: Upcoming Sheriff's Race

Trespass Issue -

If a debate between the candidates is ever scheduled, this would be a good question.

I don't know if any candidate can give a definite answer, because each case may be different, but it would be interesting to hear some thoughts.

And to the previous poster - you may want to check with some criminal defense lawyers (if you have not). Since the issue was treated criminally, a lawyer doing mostly civil might not be aware of fine points on the issue. It sounds like we might all need to talk to one on this issue if the current sheriff keeps enforcing the law this way on public beaches.

I don't want to attach the whole State Statute but it is under F.S.S. 810.

Specifically, look at F.S.S. 810.09, (check out 810.09 1(b) ) Trespass on property other than structure or conveyance (building, vehicle, etc.) From a quick review, it appears that once notice is given, "actual communication" (verbal) or posting (signs, fencing) that is enough to assume you knew better and should not have trespassed. How the law is enforced seems to be the issue. Based on the current administrations enforcement of traffic laws, (a ticket for all citizens !!!) I am not surprised that this is such an issue. All I can say is that commonsense is needed when enforcement questions arise.

Just because you have been given the authority to arrest someone, does that mean you should just go out and find someone violating a law, no matter how out dated, poorly written or understood its original intent was? If someone is knowingly driving 5 mph over the speed limit and they get stopped by law enforcement, do you give them a ticket, just because you can? Or do you assess the situtation and determine the reason for the slight lapse? Do you use your discretion?

This is a good question for discussion and it would appear that candidates (none of whom live on the South End) need to take notice of it.

Intent = Criminal. As it relates to F.S.S. 810.
