Upcoming Sheriff's Race - Josh Sconiers

Re: Upcoming Sheriff's Race

Just because you have been given the authority to arrest someone, does that mean you should just go out and find someone violating a law, no matter how out dated, poorly written or understood its original intent was? If someone is knowingly driving 5 mph over the speed limit and they get stopped by law enforcement, do you give them a ticket, just because you can? Or do you assess the situtation and determine the reason for the slight lapse? Do you use your discretion?

This is a good question for discussion and it would appear that candidates (none of whom live on the South End) need to take notice of it.

Speeding is a civil infraction. I understand discretion being used in those cases. But I am not so sure when it becomes criminal. But if we say okay, officer discretion on criminal violations, where is that line drawn? Just for misdemeanors or what?

OK, my point was missed. I am very well aware of the types of violations, infractions, etc. My point is that officers are given the ability to arrest based on violations of the law. I am not going to go into detail because something tells me you already know...

If someone unknowingly "trespasses" on to part of the beach which is private property and the owner gets upset and calls law enforcement, I would hope no arrest would be made. Perhaps a verbal warning or a formal warning of trespass (written) would be appropriate. Now if the same person knowingly trespasses repeated after being warned (by law enforcement) maybe an arrest is necessary.

Proper posting of signs is also important, ultimately, prove intent.

For what that was worth...

I may know. But what about others that are reading this discussion?

Agreed. But this beach thing is going to be something else before it is over with.

I too have read the law, mainly because of this issue. While I don't believe intent is the sole difference (mistake would seem to prevent civil liability also), the issue of notice seems to be the key for a criminal charge. If you had notice, and the officer knows that, he can make an arrest.

Most county sheriff departments issue trespass citations/warnings. After one is issued, a violation results in arrest. This is my understanding. My point earlier was that if there is a real question or confusion (you indicated so, and referred to lawyers also being unsure), maybe a criminal defense lawyer would be able to clear it up.

The problem we have is a lot of young deputies, who may not have enough training (and certainly not enough experience) to know when to exercise discretion. I believe this is the fault of the administration. These are good young men and women, but unless experienced officers give them proper training and instruction, these problems will continue to surface.

Not sure who the right choice is, but candidates like Mike Adkinson who have conducted training and know how to place experienced officers in leadership positions seems like a good choice. Others with leadership experience should let us know about that so we can make an informed decision.

You have hit the nail on the head. These are the types of issues that need to be brought to light and discussed. Regardless of posters (including me) personal political opinions, this is one of the true issues that faces us. You reference training and instruction, these are areas that I believe WCSO is lacking in. (Who are current trainers responsible for education of the staff? What type of training is conducted?) The current administration can spent money on a driving track, but how about providing funding to assist officers trying to get degrees? How about officers who actually get to know the members of the community, actually get out of the patrol car? (I used to see a few deputies and investigators each day at a local restaurant and they knew the community and were very well liked). Unfortunately, I have been told these officers have left the department for other positions in other department. Maybe if deputies were trained to communicate with citizens, they would understand the feelings of those they protect.

Any officer reading this, do not think you are not appreciated, you truly are. I just want to see you under leadership that will push you to your full potential, provide you opportunities and help you develop experience. I mean, come on, WCSO does not even have a relationship with SWFD. All because the sheriff does not like them and their past leader (who now runs the Emergency Center in Tallahassee), they do not participate in multi-juristictional task forces (this was referenced in a U.S. Marshal's press article where almost every local agency participated in a felony warrants sweep, no WCSO.

I know a few senior officers and they do try their best to help the newer officers. Unfortunately, unless they are given the support of the sheriff, they can only do so much. Many are simply job scarred and will not make comments. Some senior officers would rather eat breakfast, lunch and dinner and then go home then help any new officer, they are collecting a paycheck. I believe some of these types are documented in Dennis Wise's book.

01/29 ??? Little help here.

Oops! I made a big assumption here. Been drinking to much Republican Party of Florida koolaid. Whomever wins Florida may not win the Republican nomination.

Anyway, united with whomever the eventual Republican nominee is for President.

The slogan is actually the one the RPOF has adopted for this year. Last year it was 'Building a foundation for victory!'

Whew... You had me worried there... Your slogan popped up along with the Adkinson posts, at least that's the first time I noticed it. Thanks for clairification.

I'm right there with ya, 01/29/08.
