Trump should not have had these documents
If he broke a law or rule he should be held to account

If I were Trump and I found out I had documents that I wasn't suppose to have I would have gone full co-op and just said / emailed to whomever 'you have my full cooperation, I have cc'd my lawyer and someone to let you into me place for you convience, lets set up a meeting for your people to come over and go through whatever you would like whenever is good for you, I am sorry if I did something wrong, lets make this right, what kind of lunch / drinks can we have ready for your people, once again I apologize for the inconvenience.'

My explanation is that he or his lawyer say to the special master is under oath. Once you play a card, you have to stick with it. If you don't, and try to play another card, it's going to come off as perjury. Their problem is that every fabricated story they come up with is going to have some unknown, unintended, negative consequences. They are at wit's end trying to figure out where to go with this. if he pleads the fifth, that may not help him much, because he has clearly broken the law. How seriously he has broken it is a point in question.

Yes, they have him on Theft and Obstruction, but they have to assess the damage to decide what charges to bring about Espionage. I think they have to outline what punishment they are requesting before they can formally charge him. It’s probably quite a chore to assess all the docs because of all the ketchup and the drool.

Well, that was exhausting... but well worth the read. If ya'll want to skip some of it, here are the last two paragraphs of an approximately 20 page summary of all the litigation DJT is involved in now. The last two paragraphs:

Update-11: The special master–Judge Dearie–held his first hearing on Sept. 20, 2022. Much of the argument focused on the status of the classified documents. Trump’s counsel argued that Judge Dearie should not take the DOJ’s word that some of the seized records were classified but stopped short of arguing that Trump had actually declassified them. According to reporting, the judge “expressed skepticism” at those arguments, and indicated that he would likely deem the records classified unless Trump offered contrary evidence.

Update-12: On Sept. 21, the Eleventh Circuit granted the DOJ’s motion for a stay, meaning that the DOJ can use the classified documents in its investigation and that the DOJ need not submit those documents to the special master for review. The appeals court agreed with the DOJ that Trump could not assert a personal interest in classified records, and also noted that Trump had so far refused to advance any actual evidence that the records had been declassified.
